What the agency is looking into
A person familiar with the matter said the CFTC is testing whether Polymarket previously failed to live up to its 2022 deal to keep U.S. users off its offshore site. That person, who was not authorized to speak publicly, added that this line of inquiry does not concern how the platform currently operates. Reuters first reported this latest examination.
The agency is reviewing how Polymarket identifies where customers are based and how it markets in the U.S. It is also assessing the company's U.S. offering that went live in late December, with attention on account sign ups and safeguards.
How the probe ties to earlier reports
The broader review began earlier this year after the Wall Street Journal said Polymarket compensated content creators to share videos depicting practice trades and fake victories on test builds of its site. That source declined to say when the current CFTC inquiry began.
Back in 2022, under a CFTC enforcement settlement reached during the Biden administration, Polymarket barred U.S. users from accessing its site and agreed to a $1.4 million civil penalty. Polymarket declined to comment. The CFTC did not reply to a request for comment.

What investors should watch
The timing is one week ahead of the Nov. 3 midterm elections, and polls indicate Democrats lead in the race for the House of Representatives while the Senate remains a toss-up. It also arrives as mental health experts and lawmakers voice growing concern about the rapid expansion of prediction markets over the past year.
Why it matters: regulatory heat can influence liquidity and sentiment around platforms tied to political events. For positioning, the focus points are clear - how Polymarket enforces geolocation, how it advertises in the U.S., and the controls built into its U.S. platform that went live in late December.
