What's happening now
A confidentiality agreement that has governed the discussions is set to run out on Tuesday, adding pressure to strike terms, according to people with knowledge of the matter. Some of those people said the NDA could still be extended.
The talks run alongside a lawsuit filed earlier this month in New York by a subset of lenders alleging that the company controlled by Patrick Drahi moved most assets beyond their reach late last year. Debt held by the committee leading the talks has been quoted above prices for similar Altice International securities outside the group, reflecting expectations of better principal recovery for those so-called litco holders.
Key sticking points
People familiar with the process said the sides remain apart on how to structure compensation for Drahi and for the lenders. A similar issue surfaced in recent talks involving Optimum Communications Inc. - formerly Altice USA - where the parties this month have moved closer to a deal that would end litigation and transfer control of the telecom company to lenders.
Another live topic is how to address financing Elliott extended last year to an Altice International holding entity, which covered more than €500 million in debt refinancing, the people said. The funds repaid a relationship bank loan and, as previously reported, helped clear the way for Altice International to move certain assets beyond creditor claims because the prior financing terms would have complicated that step.

What could change if talks stall
People familiar with the matter said that, should the parties fail to clinch an agreement or the NDA not be prolonged, Altice International will release cleansing materials - financial information that had not previously been public. Some of those people said the disclosures could squeeze the price premium on the negotiating lenders' debt. Others believe the premium may be unaffected and that those creditors still look positioned for relatively stronger recoveries.
Why it matters for your portfolio
The hinge is information flow. A deal or an NDA extension keeps details private, while cleansing materials could reset pricing across Altice International's capital stack. The bottom line: whether that litco premium narrows or holds will signal how the market handicaps recovery paths for creditors inside and outside the negotiating group.
