What the regulator demanded
Kenya's Competition Authority signed off via a letter reviewed by Bloomberg, but with firm conditions. The document states that the "target entity shall prior to the completion of the transaction reserve sufficient funds from the transaction consideration to meet any outstanding liabilities." In another requirement communicated to lawyers for the brewers, EABL must ensure competitors get 20% of cooler space at retail outlets. The regulator confirmed it had received Bloomberg's request for comment.
Who is buying and who is selling
If the transaction closes, it will mark Asahi Group Holdings Ltd.'s first direct presence on the continent. For Diageo, it extends a broader pullback from Africa after selling businesses in Nigeria, Seychelles, Ghana, Cameroon and Ethiopia. According to a Diageo representative, the company welcomed CAK's decision and is still working toward closing the transaction. EABL did not respond to requests for comment.
