Democrats' sweep sets a tougher DC climate for crypto, with Clarity on ice

Published Nov 5, 2026
Share:
Summary:
  • A Democratic Congress is expected to take a harder line on crypto, sidelining industry-friendly bills like the Clarity Act.
  • TD Cowen's Jaret Seiberg sees investigations into President Donald Trump's crypto ties taking precedence and says Clarity is unlikely to move for at least two years.
  • Crypto backers spent more than $200 million in the midterms, pro-crypto candidates logged major wins, and one industry CEO predicts the CLARITY Act won't advance before 2028.

What shifted in Washington

Democrats' sweep reshapes the policy board for crypto, with skeptics such as Sen. Sherrod Brown returning to the chamber and Sen. Elizabeth Warren maintaining significant influence over financial policy. Analysts expect the agenda to tilt toward examining President Donald Trump's personal crypto dealings instead of moving industry-backed bills.

That view came through in a Wednesday note from Jaret Seiberg, TD Cowen's Washington analyst, who wrote, "We see Sherrod Brown winning in Ohio as damaging the crypto industry's political clout as the industry worked to defeat him." He added, "We did not think Clarity could advance over the next two years. This makes us more confident in our prediction," and said Democrats "will investigate Trump's crypto entanglements including World Liberty Financial," creating a political climate where a version of Clarity the sector supports may not be possible.

For years, crypto pressed for clear rules and got enforcement-first instead. After Trump's 2024 win, that briefly flipped, giving the industry a reprieve and a seat at the policy table. The new Congress likely closes that window.

Where the votes and money went

Crypto advocates poured more than $200 million into the midterms to help elect lawmakers who could carry a comprehensive market structure bill after the Clarity Act hit a wall in the Senate. As of Thursday morning, the advocacy group Stand With Crypto counted 19 senators it labels pro crypto elected versus eight it views as anti crypto, and in the House 228 pro crypto winners versus 106 it considers anti crypto. Some contests were still uncalled.

According to Reuters, Fairshake - a major spender and a super PAC formed in 2023 to support pro-crypto contenders in both parties - notched victories in 29 of the 34 contests it funded. That tally includes three of the six House hopefuls it singled out with a baseline of 1 million dollars each.

When policy shifts, thoughtful investors look to new tools to maintain an edge. We're hosting our first ever investor livestream on 11/17 to show you how to use ChatGPT and Claude to invest like a pro, hosted by Briefs Finance CEO Jaspreet Singh. Save your seat.

Industry leaders say the outlook is mixed, not bleak. Coinbase's U.S. policy lead Kara Calvert said, "With last night's results, the 120th Congress is on track to have more new pro-crypto members than we've ever seen in any freshman class." She added, "Crypto is 100% bipartisan, and that's why the future of finance does not rest on either political party or a single election night. Democrats and Republicans alike know that clear rules protect consumers and keep innovation in the U.S."

Circle executive Dante Disparte, who serves as chief strategy officer and leads its global policy and operations group, underscored a bipartisan posture and readiness for new leadership in both chambers. "With this midterm election result, folks need to see that they have some equity in this process, that they have their interests represented in this process, and therefore it may take longer to get Clarity tabled again," he said. "But I wouldn't characterize it as bad - that's been frankly too reflexive a response from industry and from other players … Crypto is purple." He pointed to the Genius Act, a "roundly bipartisan" stablecoin law enacted last year and taking effect in January, calling it a meaningful step that Democrats "will feel 1, ownership over and 2, recognition of."

What this could mean for your portfolio

The stakes run beyond market structure. Industry priorities now on the watch list include stablecoin innovation, decentralized finance development, banking access, tokenization and tax policy that does not undercut competitiveness. Progress will still need Republicans and Democrats pulling together, and while Democrats have historically been less supportive than Republicans, that gap has narrowed as more Democrats engage.

There is also a floor under the story. As crypto becomes more embedded in mainstream finance, attention is turning to its role as core plumbing. And although the CLARITY Act may be sidelined until 2028, regulators still have ample room to push forward via rulemaking.

That is where some see momentum continuing. Joseph Chalom, who serves as CEO of the ether treasury firm Sharplink, said, "We expect the CLARITY Act to remain on hold through 2028. Even so, there is a clear path forward for stablecoins … and for the tokenization of public equities under the SEC's five-year innovation exemption." His point for investors: when investors and institutions fully recognize faster settlement, reduced costs, and 24/7 markets, reversing course will be difficult no matter who captures the White House in 2028.
