Congress punts hemp THC rules to December as sales surge and nerves fray

The latest delay and how we got here

The House's short-term funding bill keeps the government open and pushes back the start of new federal limits on hemp-derived THC items to Dec. 11. That buys the hemp industry one more month to try to convince Congress to set up rules that keep these products on shelves rather than shut them out.

This stems from a measure Congress approved in November 2025 as part of government funding, which initially gave companies until this November to meet new restrictions on intoxicating hemp products permitted under the 2018 farm bill. Each extension makes production planning trickier as companies weigh how much to make while the guardrails are still in flux.

Real-world fallout for brands and distributors

The uncertainty is already reshaping orders. Jake Bullock, CEO of Cann, said wholesalers are tapping the brakes to avoid being stuck with supply if Congress bans the category. "Our distributors should be buying more from us, but they're not," he said. Even so, he said Cann sits atop Target's THC beverage rankings and ranks second among nonalcoholic drinks at Sprouts, with retailer buys hitting records even as middlemen pull back.

Smaller names are feeling it even more. Crescent Canna CEO and co-founder Joe Gerrity said the company has already laid off half its staff this year as congressional inaction weighed on the business. "Nine months after passing a bill that would kill tens of thousands of small businesses, Congress has come together and done something tremendous - given themselves an additional month to solve a problem that they created" Gerrity said. "I want to celebrate, but it shouldn't take an army of lobbyists and tens of millions of dollars for Congress to protect small businesses from Congress," he added.

Distributors are rewriting terms to protect themselves. "Many distributors are requiring documentation stipulating manufacturers will take back and reimburse them financially for any product unable to be sold due to regulatory changes," said Gerrity. "This is an unprecedented situation, and nobody wants to get left holding the bag." Bullock said Cann is betting Congress will strike a regulatory deal and is building inventory ahead of demand.

Demand is climbing while the rules lag

Shoppers are embracing THC beverages as an alcohol alternative, and sales are rising fast. NielsenIQ counted $239 million in U.S. retail sales for THC drinks across the year ending in April - 135% higher than a year prior - covering more than 1,170 products and over 200 brands.

Pushback is intensifying, too. Rep. Andy Harris, R-Md., has led efforts to block sales of hemp products, arguing that intoxicating hemp items are unregulated and put children at risk. Other lawmakers are focused on inhalable products and high-potency candies, the absence of THC caps and testing, and items with synthetic cannabinoids.

Industry voices say they want rules that look more like alcohol regulation, not a free pass. "We're winning against an abolishing argument," Bullock said, implying that lawmakers have little concern about lower-milligram THC beverages. Still, repeated deadline extensions keep production runs and distributor orders in limbo.

What it means for buyers and your wallet

For now, stores can keep selling and consumers can keep buying. The pinch point is distribution, where restocking may slow as long as Congress leaves the category's future unresolved.

For people like Erica Fabian, the stakes feel immediate. "Drinking [alcohol] is not healthy for both myself and my husband," Fabian said, who owns a business and is a military spouse. She said her husband, a Navy SEAL veteran who served 20 years and has severe post-traumatic stress disorder, finds THC beverages especially helpful. "It's an actual game-changer," she said. "I've seen it with my own eyes." Her take on the path forward: "If there is a responsible way to regulate it, I absolutely think that is the way to go."

If you have money tied to brands making, moving, or selling these drinks, the risk is straightforward. Demand is surging, but the rulebook is still being written, and each short extension keeps shelves, shipments, and shoppers guessing.
