On Friday, Judge Jane Onyango instructed everyone involved to maintain "the status quo prevailing" in Lamu, the intended site of the refinery. The court set Oct. 14 for further directions. According to George Wakahiu, an attorney for the local challengers, that means no construction can start before the court reconvenes on that date.
A group of 133 petitioners who identify as farmers and residents of the Lamu area say the project would strip them of property rights. In their filing, they argue the refinery would involve "forceful eviction of the plaintiffs from their lands, damage and destruction of their properties and yet there is no resettlement plan for them." They also contend Dangote and Kenyan authorities have not yet met the country's environmental requirements, which call for "a mandatory environmental impact assessment be done before the implementation of any major project," and say the plan falls short of Kenya's constitutional standard "which requires that the necessary public participation" be carried out. A ceremonial groundbreaking had been slated for Sept. 30.
