Pentagon's 1260H Blacklist Hangs Over Trump-Xi Summit

What the List Is and Why It Matters Now

Congress set up the 1260H roster, and in Washington it has become a go-to pressure tool. It has swelled to almost 200 entities, pulling in top Chinese brands. The June revision put Alibaba Group Holding Ltd., Baidu Inc., and BYD Co. on the roster, noting BYD as the planet's largest maker of electric cars.

That revision arrived right after Donald Trump's May visit to Beijing to meet Xi Jinping, a sequence that drew fire in Chinese state media. As the China Daily put it on June 14: "If the US president's first visit to China in nine years last month was intended to stabilize relations, the Pentagon's latest move does the opposite."

How Beijing and Washington Are Playing It

Washington has leaned harder on 1260H as competition with China intensifies over AI and other advanced tech. The designations have real-world effects: they can limit a company's ability to contract with the U.S. government and discourage lobbyists from representing them. After the June expansion, Beijing authorities blasted the move and set in motion export and purchasing limits targeting U.S. firms.

At the same time, White House officials and U.S. national security agencies have accused leading Chinese AI developers, including Alibaba, of improperly taking data from Silicon Valley firms such as Anthropic PBC and OpenAI to create competing chatbots. China's Foreign Ministry dismissed the claims and cautioned that it would take action if the Trump administration moved ahead with sanctions.

With Trump and Xi expected to address AI at this week's summit, Beijing is poised to argue Washington is trying to protect its lead by going after Chinese firms. "I would not be surprised if Beijing raises 1260H around the summit, particularly because several prominent Chinese companies now on the list are also being discussed as part of Xi's business delegation," said Craig Singleton of the Foundation for Defense of Democracies. "But there is a big difference between China raising the issue and Washington being prepared to bargain away the list."

Officials in Beijing are weighing whether to include BYD executives in Xi's delegation to Washington, and media reports, including from the South China Morning Post, say other designees such as Zhongji Innolight Co. and Contemporary Amperex Technology Co. Ltd. may also be part of the delegation. In the lead-up, top representatives from both governments gathered in New York on Sunday for discussions on AI and trade, and both reported a positive tone. Treasury Secretary Scott Bessent said the U.S. and China agreed to set up a "US-China AI dialogue" to build a shared view of the technology's risks and benefits. For now, the administration has not signaled any willingness to back off, with 1260H serving as leverage in the broader tech rivalry.

Courts and K Street Push Back

Some of the highest-profile companies on 1260H are challenging it in court. Over the past few months, Alibaba, biotech leader WuXi AppTec, Hesai Group - the world's largest producer of lidar sensors for automobiles - and DJI, the drone manufacturer, secured preliminary victories in federal cases aiming to get off the list, centered on issues like evidence and procedure. Even so, Washington advisers say these are early steps in what could be a long legal fight, and few companies have historically managed to get off the list through litigation, as judges frequently give weight to the Pentagon's national security judgments.

John McEntee - currently pressing to remove 1260H labels from Tencent Holdings Ltd. and from Zhongji Innolight, an optical transceiver manufacturer - argued that the Pentagon list, along with other compilations like the Federal Communications Commission's "covered list," has sparked an "unproductive confrontation with China." The designations "are an unnecessary point of tension in a relationship that the president has made great progress in restoring," he said. "Trump's appointees should update the lists to reflect their boss's thinking."

Meanwhile, Congress is moving the other direction.

What This Means for Your Money

This is no longer just a Washington paperwork exercise. Landing on 1260H can limit a company's ability to contract with the U.S. government and scare off lobbyists. Some firms have notched early courtroom wins, but the road is long and the destination uncertain. At the same time, Congress is trying to widen and harden the tool, not roll it back.
