Elon Musk's lawsuit against OpenAI is moving to trial, escalating his long-standing dispute with the company and its CEO, Sam Altman.
The lawsuit was filed in August 2024 in the U.S. District Court in the Northern District of California. Following a recent hearing, Judge Yvonne Gonzalez Rogers confirmed that the case would proceed.
Musk's lead counsel, Marc Toberoff, stated that OpenAI made "knowingly false assurances" regarding its charitable mission. Musk claims he was "assiduously manipulated" and "deceived" after OpenAI formed a network of for-profit affiliates.
He alleges that this move allowed OpenAI's leadership to unjustly enrich themselves by billions of dollars. OpenAI has denied these claims, describing Musk's lawsuit as part of an ongoing pattern of harassment.
In 2024, OpenAI announced intentions to transition to a for-profit company. However, after receiving pressure from civic leaders and former employees, they ultimately decided to maintain control under a nonprofit structure.
This decision was made to ensure that the nonprofit arm would continue to oversee the for-profit business, which includes a significant investment from Microsoft valued at approximately $135 billion.
Musk launched his AI company, xAI, in 2023 to compete with OpenAI and other players in the AI industry. Recently, xAI has faced scrutiny for its chatbot and image generator, which allowed users to create nonconsensual intimate images and child sexual abuse depictions.
Regulatory probes are currently underway against Musk's companies in several countries, including the European Commission and Australia.
The trial will delve into the complex relationship between Musk and OpenAI, highlighting the tensions that have developed since the company's inception.
As the case unfolds, it will also examine the implications of OpenAI's corporate structure and Musk's ongoing concerns about the ethical dimensions of artificial intelligence.
