What's at issue
Democrats are probing whether Meta tried to treat A.I. data center buildouts as research under the federal R&D credit, which is meant to reward experimental work rather than scaling out established computing infrastructure. As they wrote, "Any effort by Meta to use A.I. data center expansion as eligible for research credits is potentially a significant misapplication of federal tax law that merits further investigation." A half-dozen other Democrats joined Ron Wyden, the Senate Finance Committee's ranking member, in signing the letter.
Why this flared up now
Their questions lean on a New York Times report saying Meta labeled some A.I. data centers as "pilot models" to qualify for research credits. Lawmakers also pointed to Meta's recent investor disclosures indicating the company believed its tax strategy might not hold up under IRS review. Zuckerberg was asked to respond by Oct. 31.
The broader stakes
This pushback intensifies a wider fight between Democrats and big tech over using billions in tax incentives to bankroll the A.I. buildout. And outside Washington, the spread of energy heavy higher power bills">data centers, local water shortages, and potential job losses.
