China moves to tighten biotech exports, while keeping licensing deals alive

Published Oct 16, 2026
Share:
Summary:
  • On Friday, Beijing released a draft proposal that would place five biomedical technologies on its export-control list.
  • The proposal exempts licensing, partnerships, and contract research tied to those technologies.
  • Government data show 81 licensing agreements valued at up to $110 billion during the first half of 2026, indicating they are on pace to surpass last year's peak.

What Beijing is proposing

China's Ministry of Commerce published a draft to tighten oversight of certain biotech exports, naming five biomedical technologies for control. Two of them are next generation platforms that target disease at the genetic level.

The proposal would impose stricter limits on transferring ownership of small interfering RNA molecules that can shut off genes linked to disease, and on cell and gene therapy platforms aimed at treating cancers and rare illnesses. It further extends to work and tools connected to disease-causing microorganisms.

China also signaled new curbs for areas such as artificial intelligence and solar energy technologies.

Licensing and partnerships stay open

The draft makes clear that arrangements for licensing, partnerships, and contract research services that touch these technologies fall outside the limits. That keeps a critical channel open for foreign drugmakers that have helped power China's rise in pharma.

Global players such as AstraZeneca Plc and Pfizer Inc have been striking more cross border licenses for experimental drugs discovered by Chinese firms. According to government statistics, there were 81 licensing deals in the first half of 2026 with values reaching up to $110 billion - pointing to momentum that would overtake last year's record.

Friction and reactions

Keeping licensing open should ease nerves across the industry. US and European companies say China's pipeline offers more innovative drugs with strong sales potential. For Chinese developers, these deals bring funding and global recognition, which supports Beijing's aim to be a leader in biomedical research.

Ryan Etzcorn of Ankura China Advisors, where he holds a senior director role, said, "The controls represent a new 'coming out' moment for China's confidence in how innovative and globally competitive its biomedicine sector has become." "Chinese biotech will be open for business, but closed to technology flight."

These collaborations have also become a flashpoint between Washington and Beijing. Some US lawmakers and investors want tighter limits, and the US Treasury Department is expected to issue rules this year that could place biotech licensing deals under the same outbound investment reviews used for semiconductors and artificial intelligence systems.

What it means for your portfolio

In plain English: China plans to limit ownership transfers of sensitive biotech while keeping license based collaboration intact. Deal flow can continue, but direct tech transfers face higher walls. Keep an eye on the final Chinese rules and any US outbound review moves - both will influence cross border pipelines, upfront payments, and royalty math for drug developers and their partners.

Common Investing Mistakes: Why a Stock Grade Is One Tool, Not the Whole Toolkit
  • The Briefs Score shows growth, income, and wealth preservation investors how well a stock fits their goal, with a separate letter grade for each one.
  • The most common mistake is treating the letter as an instruction. An A tells you a stock scores well for one goal, not that you should buy today.
  • Research works best as one input in a process you own. The grade shows how a stock stacks up. You supply the goal, the timeline, and the rules for being wrong.

  • Before you buy anything, ask one question: does this put money in my pocket, or take money out of my pocket? Then you need a plan for the money you keep.
